Shop Jill’s and/or Small Talk With Jill collects personal and non-personal information that you provide while interacting with the Site. Shop Jill’s and/or Small Talk With Jill may use analytic and reporting technologies to record non-personal information such as Internet domain and host names, Internet protocol (IP) addresses, browser software, operating system types, click patterns, and the dates and times that the Site and our services are accessed by you. The California Consumer Privacy Act (“CCPA”) provides California residents with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.
Access to Specific Information. You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:
· The categories of personal information we collected about you.
· The categories of sources for the personal information we collected about you.
· Our business or commercial purpose for collecting or selling that personal information.
· The categories of third parties with whom we share that personal information.
· The specific pieces of personal information we collected about you.

Deletion Request Rights. You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
3. Debug products to identify and repair errors that impair existing intended functionality.
4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
8. Comply with a legal obligation.
9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may only make a verifiable consumer request for access or deletion once within a 12-month period. The verifiable consumer request must:
· Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
· Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through a password protected account sufficiently verified when the request relates to personal information associated with that specific account. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.
Response Timing and Format. We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time, we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.
Non-Discrimination. We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
· Deny you goods or services.
· Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
· Provide you a different level or quality of goods or services.
· Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
Other California Privacy Rights. California Civil Code Section 1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Depending on the visitor’s activity at our Site, certain “personally identifiable information” (as that term is defined in the California Act) may be collected, in addition to information set forth in other sections of this document. Under California S.B. 27 (“Shine the Light” Law), California residents have the right under certain circumstances to receive, once a year, information about third parties with whom we have shared information about you or your family for their marketing purposes during the previous calendar year, and a description of the categories of personal information shared. To make such a request, please send an email to firstname.lastname@example.org please include the phrase “California Privacy Request” in the subject line, the domain name of the Site you are inquiring about, along with your name, address and email address. We will respond to you within 30 days of receiving such a request.
For purposes of the General Data Protection Regulation (“GDPR”), Shop Jill’s is the controller of your personal data. The GDPR defines personal data as any information relating to an identified or identifiable natural person.
Processing Your Data. If you provide Shop Jill’s personal data to determine the suitability of services referenced on the Site then we will lawfully process your personal data to perform a contract with you or take steps at your request prior to entering into a contract. We internally process your personal data for our legitimate business interests, like improving Shop Jill’s services, in a manner that does not outweigh your fundamental rights and freedoms. If you provide your personal data to receive a subscription email, then we will process your information to provide you with the requested subscription. If you would like to withdraw your consent to receiving a subscription email, then you may complete the unsubscribe process within the subscription email. In some cases, we will use your personal data for direct marketing, in which case you have the right to object to direct marketing.
Categories of Recipients of Your Personal Data. We employ third-party service providers to administer and provide services on our behalf (including, but not limited to, a cloud service provider) who may need your personal data to provide services for Shop Jill’s. These third-party service providers are restricted from using your personal data for any purpose other than to provide the services requested by Shop Jill’s and/or Small Talk With Jill.
Data Subject Rights. The GDPR provides certain rights for individuals. You may request information about: the purpose of processing; the categories of personal data concerned; third parties that may have received your personal data from Shop Jill’s and/or Small Talk With Jill; the source of your personal data (if you did not provide it directly to Shop Jill’s); and how long your personal data will be stored. You have a right to correct your personal data record maintained by Shop Jill’s and/or Small Talk With Jill if it is inaccurate. Subject to certain exceptions, you may request that Shop Jill’s erase your personal data or cease processing your personal data. You have the right to receive, or transmit to another controller, personal data concerning you that you have submitted to Shop Jill’s and/or Small Talk With Jill. Shop Jill’s and/or Small Talk With Jill will provide reasonable access to your personal data at no cost upon request and if access cannot be provided within a reasonable time frame, Shop Jill’s will provide you with a date when the information will be provided. Transferring Personal Data from the EU to the United States. The information we collect from you is processed in the United States. The United States has not sought, nor received, a finding of “adequacy” from the European Union under Article 45 of the GDPR. We rely on derogations for specific situations as set forth in Article 49 of the GDPR. In particular, we collect and transfer to the U.S. personal data only: with your consent; to perform a contract with you; or to fulfill a compelling legitimate interest of Shop Jill’s when your rights and freedoms are not overriding.
Data Storage and Retention. Your personal data is stored by Shop Jill’s and/or Small Talk With Jill on cloud-based database management services located in the United States. We retain data for the duration of your business relationship with Shop Jill’s and for a period of time thereafter to satisfy legal requirements.
